Part-NCO Explained for Private Pilots: The 6 Rules That Trip People Up

Part-NCO sits behind a large part of everyday private flying in Europe. It applies operational rules to non-commercial flights conducted with aircraft that are not classed as complex motor-powered aircraft. For many PPL and LAPL holders, that means the rules are relevant every time they rent a club aeroplane, take a friend flying or make a cross-country trip.
The difficulty is rarely finding the rules. The harder part is understanding how separate requirements work together during a normal flight. A pilot may know the fuel figure from training but miss the requirement to protect that reserve in flight. Another may carry electronic charts but overlook the need for a reliable backup. Small misunderstandings can become significant when weather changes or a passenger needs help.
This article explains six Part-NCO areas that private pilots often misunderstand. It focuses on aeroplane operations, although several principles also apply to helicopters. National rules, aircraft limitations and local procedures may add further requirements, so always check the material relevant to the State and aircraft involved.
What does Part-NCO cover?
Part-NCO is Annex VII to the European Air Operations rules. In broad terms, it covers non-commercial operations with aircraft other than complex motor-powered aircraft. A typical private flight in a light single-engine piston aeroplane falls within this framework.
The first useful question is therefore not simply, “Am I flying privately?” You also need to consider the aircraft and the nature of the operation. Complex motor-powered aircraft are generally dealt with under Part-NCC for non-commercial operations. Specialised activities can bring Part-SPO or specific Part-NCO requirements into play. Commercial air transport follows a different framework.
For the ordinary private pilot, the practical lesson is simple. Do not treat Part-NCO as a remote set of rules written only for operators. It places direct duties on the pilot-in-command, and many of those duties apply before the engine starts.
Rule 1: The pilot-in-command carries the operational responsibility
Part-NCO makes the pilot-in-command responsible for the operation and safety of the aircraft, as well as the safety of the people and cargo on board. This responsibility does not transfer to a flying club because the club owns the aeroplane. It does not disappear because an instructor, experienced pilot or engineer offered advice before departure.
This is especially relevant when renting an aircraft. The organisation may control maintenance, technical records and booking procedures, but the pilot-in-command still has to decide whether the intended flight can be conducted safely and legally. That includes checking the aircraft status, available information, weather, fuel, loading and equipment.
The rule also gives the pilot-in-command authority to take any action considered necessary for safety. If a passenger is distracting, an item of baggage is insecure or the weather is deteriorating, the pilot does not need to continue merely because the flight was planned or paid for. Safety decisions belong in the cockpit.
A useful pre-flight question is: “What information do I personally need before I can accept this aircraft and flight?” A club dispatch process may support that decision, but it cannot replace it.
One common trap is allowing familiarity to reduce the quality of preparation. A local flight in an aeroplane flown many times can feel routine. Part-NCO does not create a lower standard because the route is familiar. The pilot-in-command must still be satisfied that the aeroplane, conditions and intended operation are suitable.
Rule 2: The local-flight document exception is narrower than it looks
Part-NCO lists documents, manuals and information that must be carried on each flight. These include the aircraft flight manual or equivalent document, registration certificate, certificate of airworthiness, applicable noise certificate, radio licence, insurance evidence and journey log. The list also covers filed flight-plan details where applicable, current suitable charts, interception procedures and other documents required for the flight.
There is a useful exception for a flight that intends to take off and land at the same aerodrome or remains within a distance or area set by the competent authority. Some aircraft documents may then be retained at the aerodrome. Pilots sometimes interpret this as permission to leave all documentation behind for any short flight. It is not that broad.
The aircraft flight manual is not included in the group that may be left at the aerodrome under this exception. Current charts and information needed for a diversion also remain relevant. A short local flight can still be affected by an aerodrome closure, worsening weather or an aircraft problem that requires a landing elsewhere.
Electronic documents are acceptable when their accessibility, usability and reliability can be assured. This point matters. Saving a chart on a tablet is not enough if the device has little battery power, the app is not working or the pilot cannot access the information without a data connection.
Before departure, check that electronic material is downloaded and current. Confirm that the screen is readable in the cockpit and that charging cables cannot interfere with the controls. If an electronic chart or checklist is important to the flight, arrange a suitable backup.
The practical standard is not “I can probably retrieve it.” The information should be available when workload is high and the mobile network is not cooperating.
Rule 3: Final reserve fuel is protected fuel
Fuel planning is an area where older teaching summaries can cause confusion. The current Part-NCO rule requires the pilot-in-command to carry enough fuel or energy and oil after considering the weather, aircraft performance, expected delays and reasonable contingencies. It also requires a planned final reserve that supports a safe landing.
For an aeroplane flying VFR by day, the accepted planning figure is generally enough fuel for 30 minutes at holding speed at 1,500 feet above the destination. For VFR at night and IFR, it is 45 minutes at holding speed at 1,500 feet above the destination or alternate. A narrower figure of 10 minutes at maximum continuous cruise power applies only to a day VFR flight that takes off and lands at the same aerodrome or landing site and remains in sight of it.
That 10-minute case is easy to misuse. It does not apply to an ordinary local flight merely because the route is short. The aeroplane must remain within sight of the departure and landing site throughout.
The larger point is that final reserve fuel is protected. It is not a spare amount intended to absorb routine delays. The planned figure should be known before flight and monitored in a form that is easy to compare with the fuel remaining.
If an ATC-controlled flight is committed to a particular landing site and any further delay could lead to landing below the planned final reserve, the pilot should declare “MINIMUM FUEL”. This advises ATC that the available options have narrowed. It does not itself create priority.
If the usable fuel expected on landing at the nearest place where a safe landing can be made will be below the planned final reserve, the situation is a fuel emergency. The correct declaration is “MAYDAY MAYDAY MAYDAY FUEL”. Waiting until the engine is close to stopping defeats the purpose of the rule.
A reliable fuel plan therefore needs separate allowances for taxi, trip fuel, foreseeable delays, diversion where required and the protected final reserve. In flight, compare actual consumption against the plan at useful decision points. If the figures are moving in the wrong direction, act while good landing options remain.
Rule 4: A passenger briefing is required, even for experienced passengers
Part-NCO requires the pilot-in-command to ensure that passengers receive a briefing on emergency equipment and procedures before the flight or, where appropriate, during it. The rule does not exclude passengers who have flown before. It also does not disappear for a brief sightseeing flight.
The briefing should cover the location and use of seat belts. Where applicable, it should explain emergency exits, life-jackets, oxygen equipment, life rafts and other emergency equipment intended for individual use. Passengers should also understand the location and general use of the principal emergency equipment carried for everyone on board.
A useful briefing should be specific to the aircraft. Show the passenger how the door or canopy opens and how it can be secured. Explain how to adjust and release the restraint. Point out controls that must not be touched. Discuss sterile-cockpit periods, including taxi, take-off, approach and landing, so the passenger knows when conversation must stop.
The briefing should also set expectations about illness or anxiety. Ask passengers to tell you early if they feel unwell, uncomfortable or concerned. A passenger who remains silent until the situation becomes severe can create a much greater distraction.
Avoid delivering the briefing as a rushed speech while taxiing. The passenger needs time to see the equipment and ask questions. A concise, calm explanation beside the aircraft is more effective.
The pilot should also check that each passenger occupies an appropriate seat and has the restraint secured during taxi, take-off and landing, as well as whenever safety requires it. The passenger’s agreement is not a substitute for the pilot’s check.
Rule 5: VFR weather compliance continues after take-off
A VFR flight may only be commenced or continued when the latest available meteorological information indicates that conditions along the route and at the destination will meet the applicable VFR operating minima at the expected time of use.
The words “or continued” deserve attention. A legal departure does not guarantee a legal or safe arrival. Forecasts can be wrong, visibility can reduce and cloud can lower around terrain. Part-NCO requires an ongoing decision, supported by the latest information available.

This also means that checking the destination report alone is insufficient. The route matters. A destination may remain in good conditions while a ridge, coastline or narrow valley becomes unsuitable. The time of use matters as well. A report that was acceptable before departure may no longer describe the conditions expected when the aircraft reaches the area.
Set practical decision points before flying. Identify places where you can turn back, divert or land while the options remain comfortable. Decide what visibility, cloud base or weather trend will trigger action. These personal limits may need to be more conservative than the legal minima, particularly for an inexperienced pilot or an unfamiliar route.
Avoid pressing on beneath lowering cloud to preserve a planned arrival. Lowering the aircraft can reduce terrain clearance and radio coverage while increasing workload. Turning around early is a normal operational decision.
Part-NCO also addresses ground and in-flight icing. Take-off should not begin when a deposit on the aircraft could adversely affect performance or controllability, except where the aircraft flight manual permits it. A pilot should not intentionally enter expected or actual icing unless the aircraft is certified and equipped for those conditions.
Rule 6: Required equipment changes with the flight
Private pilots sometimes treat the aircraft equipment list as fixed. In reality, the required equipment depends on the aircraft, route, airspace, operating conditions and people on board.
For example, an aeroplane must have the instruments required for the kind of operation. Radio equipment is required where the airspace demands it, and it must support the necessary two-way communication. Navigation equipment must be suitable when the route cannot be flown by visual reference to landmarks. Flights over water or remote terrain can bring requirements for flotation or survival equipment.
Emergency-location equipment is another area worth checking. Depending on the aeroplane’s certification date and seating configuration, the requirement may be met by an emergency locator transmitter, an automatic transmitter or, for an aeroplane with six seats or fewer, a survival transmitter or personal locator beacon carried by an occupant. A loose assumption that every club aircraft has the same fit can lead to trouble when changing type.
Oxygen is often misunderstood because the rule begins with the pilot-in-command’s safety assessment. Crew should use supplemental oxygen whenever the intended altitude could impair their faculties, and oxygen should be available to passengers when lack of oxygen could harm them.
When the pilot cannot determine the effect on everyone aboard, the rule provides clear thresholds. Essential crew must use oxygen for any period exceeding 30 minutes when cabin pressure altitude is between 10,000 and 13,000 feet. Everyone must use it whenever cabin pressure altitude is above 13,000 feet.
Those figures are not a promise that nobody will experience hypoxia below 10,000 feet. Health, age, smoking, medication and individual susceptibility can change the risk. The safer decision may be to use oxygen earlier or remain lower.
The equipment check should therefore be linked to the actual flight. Ask where the route goes, what airspace will be used, how high the aircraft will fly and what an emergency landing would involve. Then confirm the aircraft carries serviceable equipment that meets those needs.
A practical Part-NCO pre-flight routine
Part-NCO becomes easier to manage when its requirements are built into a repeatable preparation routine. Start by confirming the regulatory framework for the aircraft and operation. Then establish who will act as pilot-in-command and whether that person is ready to accept the flight.
Review the aircraft’s technical status and limitations. Check the required documents and confirm that electronic information is current, charged and backed up. Build the fuel plan around the intended route, likely delays and a protected final reserve. Examine the weather along the whole route and decide in advance which changes will trigger a diversion or cancellation.
Match the carried equipment to the airspace, terrain, water crossings and planned altitude. Brief passengers before workload increases. Once airborne, monitor fuel and weather against the plan rather than waiting for a warning to force a decision.
This approach is valuable because the rules stop being isolated facts. They become part of one operational judgement.

Final thoughts
Part-NCO is not intended to make private flying unnecessarily complicated. It establishes a practical safety framework for aircraft, pilots and passengers. The parts that cause difficulty tend to be the exceptions and the points where a requirement changes with the flight.
Remember the central ideas. The pilot-in-command owns the operational decision. The local-flight document exception has limits. Final reserve fuel must be protected. Passengers need an aircraft-specific briefing. Weather compliance continues in flight. Equipment must match the route and conditions.
